These terms ("Terms") govern your use of the D4 Build Overlay desktop application and the db4builds.com website (together, the "Service"). By downloading, installing, or running the app, you agree to these Terms. If you don't agree, don't install it.

1. Not affiliated with Blizzard

D4 Build Overlay is an independent, fan-made tool. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Blizzard Entertainment, Inc., Activision Blizzard, Inc., or any of their subsidiaries or affiliates. "Diablo", "Diablo IV", "Battle.net", and related marks are trademarks of Blizzard Entertainment. We use these names only to describe what the tool works with, under nominative fair use.

2. What the Service does and doesn't do

D4 Build Overlay is a purely visual guide. It:

  • Parses public build data from community sites (Mobalytics, Maxroll, Icy-Veins)
  • Displays a step-by-step HUD and click-through overlay on top of the Diablo IV window

It does not, and will never:

  • Read or write Diablo IV memory
  • Inject code into the Diablo IV process
  • Send input (mouse clicks, key presses) to Diablo IV on your behalf
  • Automate any in-game action
  • Modify the Diablo IV game files or installation

Every click in the game is performed by you. We believe this places the tool on the right side of Blizzard's End-User License Agreement, which prohibits automation and memory manipulation — but we make no legal guarantees. See Section 6 ("Your Diablo IV Account").

3. License to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and run the D4 Build Overlay app on devices you own or control, for non-commercial use. You may not redistribute, resell, or sublicense the app or any of its components without our prior written consent.

During alpha (now through late May 2026), the app is provided free of charge. We reserve the right to set pricing for non-alpha versions. If we introduce paid features after alpha, users who opted in to telemetry during alpha will get a thank-you — details TBD.

4. Build data

The Service fetches publicly-accessible build data from third-party sites (Mobalytics, Maxroll, Icy-Veins). We do not own that data; the respective site operators and build authors do. We are a read-only consumer that does not bypass authentication, rate limits, or any access control. If a third-party site changes its data format or access terms, our ability to parse their builds may change without notice.

The catalog of Paladin / Barbarian / Druid / etc. builds bundled with the app is a structured representation of that public data, provided for your personal convenience. If you are a build author and want your build removed from the catalog, email takedown@db4builds.com and we'll remove it in the next release.

5. Privacy

See our Privacy Policy for the full breakdown of what we do and do not collect. In short: nothing unless you opt in during first-run setup. If you opt in, only anonymous events and your resolution. Ever.

6. Your Diablo IV Account

You are solely responsible for your Battle.net and Diablo IV accounts. We have designed the Service to be compliant with Blizzard's policies as we understand them, but Blizzard reserves the right to interpret and enforce their EULA however they choose. We cannot guarantee that running the Service will not result in warnings, suspensions, or bans from Blizzard, and we will not be liable if that happens.

If you are concerned, don't use the Service. Blizzard's rules, not ours, govern your account.

7. No warranty

The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, or that it will continue to work with future versions of Diablo IV.

8. Limitation of liability

To the maximum extent permitted by law, in no event shall the project maintainers, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or account value, arising from or related to your use of (or inability to use) the Service.

Our total cumulative liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us for the Service, which during alpha is $0.

9. Indemnification

You agree to indemnify and hold harmless the project maintainers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, violation of these Terms, or violation of any third-party right (including Blizzard's EULA).

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if we believe you are using the Service to violate someone else's rights or any law. Upon termination, you must uninstall the app. Sections 1, 2, 7, 8, 9, and 11 survive termination.

11. Governing law

These Terms are governed by the laws of the jurisdiction where the project maintainers primarily operate. Any dispute shall be resolved in the courts of that jurisdiction, and you consent to their exclusive jurisdiction. If you are in the EU, you retain any non-waivable consumer-protection rights under your local law.

12. Changes to these Terms

If we materially change these Terms, we'll bump the "Last updated" date at the top and either email opt-in users or post a notice on the website. Continued use after the change date constitutes acceptance. If you don't agree, uninstall the app.
